P. 186-201.У дослідженні проаналізовано об’єктивні передумови покращення захисту прав трудових мігрантів в Україні. Методологія дослідження включала діалектичне поєднання таких інструментів, як документальне спостереження та юридична герменевтика. Серед основних результатів виділяємо: проаналізовано статистичні матеріали та норми чинного законодавства України, що регулюють права трудових мігрантів. Визначено проблеми щодо реалізації прав трудових мігрантів в Україні. Визначено об’єктивні передумови для покращення захисту прав трудових мігрантів в Україні. Зазначалося, що реалізація прав трудовими мігрантами в країні залежить від низки умов і, насамперед, це стосується специфіки правового регулювання цього питання. Зроблено висновок, що українське законодавство пропонує загальні гарантії запобігання дискримінації іммігрантів щодо реалізації ними права на працю. У той же час застосування прав іммігрантів у нашій країні залежить від ряду об'єктивних і суб'єктивних умов, які слід обговорити. The study analyzed the objective prerequisites for improving the protection of the rights of labor migrants in Ukraine. The research methodology included a dialectical combination of tools such as documentary observation and legal hermeneutics. Among the main results, we highlight: statistical materials and norms of the current legislation of Ukraine, which regulate the rights of labor migrants, were analyzed. Problems regarding the realization of the rights of labor migrants in Ukraine have been identified. Objective prerequisites for improving the protection of the rights of labor migrants in Ukraine have been determined. It was noted that the realization of the rights of labor migrants in the country depends on a number of conditions and, first of all, it concerns the specifics of the legal regulation of this issue. It was concluded that the Ukrainian legislation offers general guarantees of preventing discrimination against immigrants regarding their exercise of the right to work. At the same time, the application of the rights of immigrants in our country depends on a number of objective and subjective conditions that should be discussed.
