Запропонована класифікація, визначені ознаки та структура злочинних груп, створених для незаконного видобування вугілля, а також проаналізовані суб’єктно-особистісні властивості їх учасників. Розкрито значення участі кожного із учасників злочинної групи в незаконному видобуванні вугілля. Визначено їх важливість для організації розслідування даного різновиду злочинів. Article deals with investigation of offender as an element of criminalistic characteristic of illegal coal mining. The author of the work done by criminalistic generalization of scientific research to investigate the ecological crimes. Given the general classification of the subjects of ecological crimes set out in the literature, and based on data from the research, the proposed classification of criminal groups who commit illegal coal mining and singled out their features. Criminal groups are classified according to the following criteria: in the form of complicity in the crime; the degree of involvement of criminals; by the nature of involvement of criminals; by the method of sale of illegally extracted coal; by area action; on the basis of place of residence coincidence members of criminal groups (places of their permanent location) and place of commission of illegal coal mining. The mechanism of illegal coal defines the features of structure of criminal groups and the process of distribution of functions among their members. Based on the results of referrals criminal proceedings author of the article was proposed structure of criminal groups, which includes the organizer; performers (machinists, miners, transports) and distributors. The characteristic of each of the members of the criminal group who participate in illegal coal mining and mentioned their importance in the organization of this kind of crime investigation. Are generalized information on the subject and personal characteristics (gender, age, education, characteristic of the place of residence, employment, criminal record) persons involved in criminal activities of groups that illegally mined coal. Allocated the typical signs of people, which to some extent distinguish them from the world, demonstrate their individuality and characteristic. Analyzed in the article the most important in the forensic aspect of the elements of criminal groups who commit illegal coal mining, allowing practitioners to determine a course of conduct the investigation, more competently build a plan investigating indicated variety crimes, to put forward scientifically grounded version, and better organize its activities to expose the chain of persons engaged in the illegal mining of coal.uk-UAArticle
