Методологія дослідження ювенальної віктимності». «Juris Europensis Scientia». – 2021. – № 6. – С.74-77У статті розглянуто особливості методології дослідження ювенальної віктимності. Автор зазначає, що віктимологія протягом тривалого часу вважалась одним із напрямів кримінологічного вчення, що обумовлювалось очевидною інтеракцією кримінального правопорушника та потерпілого як основної детермінанти суспільно небезпечного діяння. На сучасному етапі розвитку циклу кримінально-правових наук ученими було доведено, що віктимологія є окремим ученням у межах предмета кримінології. Саме тому, як і кримінологію, її цікавить проблема створення сучасних стратегій ефективного запобігання кримінально протиправній діяльності. Однак методологія віктимологічного дослідження нині залишається аналогічною кримінологічній. Зазначено, що в сучасному розумінні існує такі три категорії проблемних питань методології дослідження ювенальної віктимності: проблемні питання, пов’язані з трансцендентними атрибутивними ознаками феномена ювенальної віктимності; проблемні питання, пов’язані з імперативністю та субпідрядністю віктимологічної науки; проблемні питання, обумовлені станом методологічних розробок у вітчизняних кримінально-правових науках. Звертається увага на те, що в складній взаємодії наук кримінально-правового циклу втрачається єдиний елемент, котрий їх об’єднує за загальною метою, яка полягає у подоланні кримінально протиправної активності. Таке подолання можливе виключно за рахунок перевиховання кримінального правопорушника та жертви шляхом зниження індексу її віктимності. Низка сучасних методів, спрямованих на вивчення кримінально протиправних діянь та віктимної поведінки жертви, застосовується або неповною мірою, або неправильно, що приводить до втрати дієвості та отримання неправдивих результатів дослідження. Саме тому в сучасних дослідження вчені все частіше намагаються створювати комплекси взаємозалежних, але різних за своєю сутністю методів. Підсумовується, що методологія дослідження феноменології ювенальної віктимності являє собою взаємоузгоджений комплекс методів та прийомів наукового пізнання особливостей виникнення та розвитку ювенальної віктимності, її понятійно-категорійного апарату, детермінації, способів та форм запобігання, що відбувається шляхом іманентного руху мислення від феномена до сутності шляхом трансформації абстрактного в конкретне та одиничного в узагальнене. The article considers the peculiarities of the methodology of juvenile victimization research. The author points out that victimology have long been considered one of the areas of criminological doctrine, due to the obvious interaction of the criminal offender and the victim as the main determinant of a socially dangerous act. At the present stage of development of the cycle of criminal law sciences, scientists have proved that victimology is a separate doctrine within the subject of criminology. That is why, like criminology, she is interested in the problem of creating modern strategies for the effective prevention of criminally illegal activities. However, the methodology of victimization research currently remains similar to criminological. It is pointed out that in the modern sense there are three categories of problematic issues of the methodology of juvenile victimization research: 1) problematic issues related to the transcendent attributive features of the phenomenon of juvenile victimhood; 2) problematic issues related to the imperative and subcontracting of victimization science; 3) problematic issues due to the state of methodological developments in the domestic criminal law sciences. Attention is drawn to the fact that in the complex interaction of the sciences of the criminal law cycle, the only element that unites them for a common goal, which is to overcome criminal activity, is lost. Such overcoming is possible only due to re-education of the criminal offender and the victim, by lowering the index of her victimhood. A number of modern methods aimed at studying criminally wrongful acts and victim behavior of the victim are used either not fully or incorrectly, which leads to loss of effectiveness and false results of the study. That is why in modern research, scientists are increasingly trying to create complexes of interdependent but different in nature methods. It is concluded that the methodology of research of the phenomenology of juvenile victimhood is a mutually agreed set of methods and techniques of scientific knowledge of the origin and development of juvenile victimhood, its conceptual and categorical apparatus, determination, methods and forms of prevention, which occurs by immanent in the concrete and the singular in the generalized.
