С. 55-58.На підставі дослідження проблематики участи прокурора у господарському судочинстві робиться висновок, що у зв’язку з тим, що інтереси держави є оціночної категорією, позовна заява повинна містити чітке посилання на нездійснення або неналежне здійснення органами державної влади, органами місцевого самоврядування чи іншим суб'єктом владних повноважень, до компетенції якого віднесено відповідні повноваження щодо захисту інтересів держави, або відсутність такого органу. Суд першої інстанції повинен з’ясувати обґрунтованість таких посилань та підстави представництва прокурором інтересів держави. Безпідставність звернення прокурора до суду щодо захисту інтересів держави має бути підставою для скасування судового акту та притягнення прокурора до відповідальності. On the basis of the study of the problems of the prosecutor's participation in economic proceedings, it is concluded that due to the fact that the interests of the state are an evaluative category, the statement of claim must contain a clear reference to non-implementation or improper implementation by state authorities, local self-government bodies or another subject authority, the competence of which includes the relevant authority to protect the interests of the state, or the absence of such an authority. The court of first instance must find out the validity of such references and the grounds for the representation of the state's interests by the prosecutor. The groundlessness of the prosecutor's appeal to the court regarding the protection of the state's interests should be the basis for canceling the court act and bringing the prosecutor to justice.uk-UA
