Буга // Правові новели. ‒ 2023. ‒ № 21. ‒ С. 38‒46.У світлі нових викликів сучасності та потреб українського суспільства у відбудові житлових кварталів, адміністративних будівель інших об’єктів інфраструктури, які були знищені чи пошкоджені внаслідок воєнних дій, розпочатих російським агресором, сфера будівництва набирає якісно та кілько нових обертів. Відповідно особливу значущість становить адміністративно-правовий механізм запобігання правопорушенням у означеній сфері. У статті автором здійснений аналіз наукових праць, присвячених запобіганню правопорушенням у сфері будівництва в Україні, дозволив встановити, що основна увага вчених та юристів-практиків в частині предмету дослідження зосереджена на питаннях: адміністративно-правового регулювання правовідносин та реалізації державної політики у сфері будівництва; визначення шляхів та методів протидії правопорушенням; розробку і вдосконалення методів екологічної оцінки впливу, яка допомагає передбачати та оцінювати можливі негативні впливи будівельних проєктів на довкілля; соціального впливу будівництва на місцеві громади та способи забезпечення етичної практики в будівельних проєктах; методів взаємодії з громадськістю та спільної участі у прийнятті рішень, щоб забезпечити більшу відкритість і врахування думок громадськості в плануванні та виконанні будівельних проєктів; розробки нових методів та підходів до будівництва, які сприяють сталості та довкіллю (включає планування зелених будівельних проєктів та використання відновлюваних джерел енергії); удосконалення будівельних процесів за рахунок використання сучасних технологій (смарт, штучний інтелект тощо) для підвищення ефективності будівництва та контролю екологічних стандартів. Такі наукові здобутки сприяють вдосконаленню практики запобігання правопорушенням в сфері будівництва, однак у більшості допомагають вирішувати лише завдання кримінального провадження, технічні, господарські, екологічні, економічні та соціальні виклики у різних галузях будівельної діяльності, що обумовлює необхідність подальшого наукового пошуку, зокрема, щодо визначення стратегічних напрямів для суб’єктів запобігання протиправним діям з врахуванням, як тенденцій реалій суспільства, так і масштабного плану майбутньої післявоєнної відбудови. У цьому контексті важливим кроком є концептуалізація наукових ідей і підходів до створення якісно нового адміністративно-правового механізму забезпечення безпеки, аналізу складових організації та здійснення будівельної діяльності, виявлення й профілактика порушень у означеній діяльності, удосконалення регулятивного законодавства й правозастосовної практики. In light of the new challenges of modernity and the needs of Ukrainian society in the reconstruction of residential quarters, administrative buildings and other infrastructure objects that were destroyed or damaged as a result of military operations initiated by the Russian aggressor, the field of construction is gaining quality and several new momentum. Accordingly, the administrative and legal mechanism for the prevention of offenses in the specified area is of particular importance. In the article, the author’s analysis of scientific works devoted to the prevention of offenses in the field of construction in Ukraine made it possible to establish that the main attention of scientists and legal practitioners in the part of the research subject is focused on the issues of: administrative and legal regulation of legal relations and implementation of state policy in the field of construction; determination of ways and methods of countering offenses; development and improvement of environmental impact assessment methods, which helps predict and assess possible negative impacts of construction projects on the environment; the social impact of construction on local communities and ways to ensure ethical practice in construction projects; methods of interaction with the public and joint participation in decision-making to ensure greater openness and consideration of public opinion in the planning and implementation of construction projects; developing new methods and approaches to construction that promote sustainability and the environment (including planning green building projects and using renewable energy sources); improvement of construction processes due to the use of modern technologies (smart, artificial intelligence, etc.) to increase the efficiency of construction and control of environmental standards. Such scientific achievements contribute to the improvement of the practice of crime prevention in the field of construction, but in most cases they help to solve only the tasks of criminal proceedings, technical, economic, environmental, economic and social challenges in various fields of construction activity, which necessitates the need for further scientific research, in particular, regarding the defi nition of strategic directions for the subjects of the prevention of illegal actions, taking into account both the trends of the realities of society and the large-scale plan of the future post-war reconstruction. In this context, an important step is the conceptualization of scientific ideas and approaches to the creation of a qualitatively new administrative and legal mechanism for ensuring safety, analyzing the components of the organization and carrying out construction activities, identifying and preventing violations in the specified activity, improving regulatory legislation and law enforcement practice.
