Визначаються загальні проблемні питання правового регулювання стосовно особливого порядку кримінального провадження, обумовленого правовим режимом воєнного стану, та пропонуються шляхи їх вирішення. The article examines the general issues of legal regulation of the special procedure of criminal proceedings due to the legal regime of martial law. An analysis of recent research and publications shows that although proceduralists have explored some of the problems associated with the regulation of the special criminal procedure under martial law, there are still unexplored issues. The purpose of the article is formulated as a study of general issues of legal regulation of the special order of criminal proceedings due to the legal regime of martial law. It is indicated that in order to achieve this desired result, the following tasks should be performed: to analyze the criminal procedural legislation and scientific views on the special procedure of criminal proceedings under the martial law; to identify general problematic issues of legal regulation in relation to the specified special procedure of criminal proceedings and to suggest ways of their solution. During the presentation of the main material it is noted that the conditions of martial law require the implementation of a differentiated criminal procedural form, “special” criminal procedural rules. It is noted that the legal regulation of the special procedure of criminal proceedings due to the legal regime of martial law is imperfect and needs legislative refinement. It is proposed in the content of the criminal procedure law in terms of legal regulation of criminal proceedings in martial law to list not individual articles, but to determine the chapters on all measures to ensure criminal proceedings, investigative (investigative) actions on which judicial control of the investigating judge may be replaced by prosecutorial supervision the head of the relevant prosecutor's office. It is determined that the legal regulation of the special procedure of criminal proceedings under the martial law should be improved by optimizing the structure of Section IX-1 of the Criminal Procedure Code of Ukraine, supplementing the latter with other articles designed to regulate criminal proceedings during hostilities. Prospects for further research in this area are outlined.uk-UAArticle
