С. 118—124.У статті розкрито адміністративно-правові засади діяльності центрів безоплатної правової допомоги, що знаходяться у сфері управління Міністерства юстиції України. З’ясовано комплексну структуру державних інституцій, що забезпечують організацію безоплатної правової допомоги в межах адміністративного, кримінального, цивільного процесів. Зазначено про недоліки функціонуючої системи безоплатної правової допомоги та запропоновано напрямки її вдосконалення. The article is devoted to the administrative and legal bases of activity of The Free Legal Aid Centers which are in the sphere of management of The Ministry of Justice of Ukraine and provide the organization of free legal aid within the limits of administrative, criminal, civil processes. The Law of Ukraine “On Free Legal Aid” of 02.06.2011 № 3460-VI regulates the content of the right to free legal aid, the procedure for implementation, grounds and procedure for providing such assistance, as well as the state guarantees for its provision. This Law distinguishes Free Primary and Secondary Legal Aid. The subjects of Free Primary Legal Aid are the executive authorities, the local governments, the physical and legal entities of private law, the specialized institutions, The Free Secondary Legal Aid Centers. The relevant local and regional centers are the subjects of Free Secondary Legal Aid. According to the provisions of current legislation, powers, territory of activity, practice of relations between The Free Legal Aid Centers, the administrative vertical of The Free Legal Aid Centers has the following form: The Coordination Center for Legal Aid Provision; Regional Free Secondary Legal Aid Centers; Local Free Secondary Legal Aid Centers. The Coordination Center organizes, provides and controls the activities of Free Legal Aid Centers. It does not provide legal assistance directly, except for legal education. These activities are carried out under the direction of the Ministry of Justice, which forms and implements the state legal policy in the field of free legal aid. The Regional Center provides protection by providing free secondary legal aid to the person under administrative detention or administrative arrest, as well as to persons who, in accordance with the provisions of the Criminal Procedure Code of Ukraine, have a certain procedural status in criminal proceedings. At the same time, a substantial part of the competence of The Regional Center is related to the activities of management, coordination, control, inspection of the activities of subordinate local centers and other issues. This indicates the subordination of local centers to the regional in relation to internal issues of work organization.
