С.145-148.Короткий огляд Стаття присвячена питанням з’ясування теоретико-правових категорій забезпечення реалізації права на освіту з боку органів державної влади. Визначено, що право на освіту є формою реалізації інтересів людини, що визначає міру індивідуальної свободи, зумовленою властивостями політичної, соціально-економічної та культурної діяльності органів державної влади в освітньому процесі, що розкриває характер взаємин особистості, суспільства і держави в цій галузі. Охарактеризовано зміст і принципи права людини на освіту. Надається аргументація, що принцип державної участі в освіті відображає позитивну свободу індивіда в сфері освіти і реалізується через здійснення державою в сфері освіти своїх основних функцій. При цьому обов’язки держави у сфері освіти не обмежуються встановленими міжнародними актами – вони розширюються в національному законодавстві та підзаконних актах. У той же час, інтереси держави, особи і суспільства в освітніх відносинах збігаються. Зроблено висновок, що проведений комплекс заходів з боку уповноважених органів державної влади, насамперед Міністерства освіти і науки України, у доступі населення до освіти мали деякі позитивні результати. Однак нормативно-правове регулювання освітнього процесу не спирається на чітку вивірену концепцію, а прийняті підзаконні акти часом суперечливі, що не сприяє формуванню єдиної системи правового регулювання освітньої системи. The article is sanctified to the questions of finding out of categories of providing of realization of right to education from the side of public authorities. Certainly, that a right to education is the form of realization of interests of man that determines the measure of individual freedom, predefined by properties of political, socio-economic and cultural activity of public authorities in an educational process, that exposes character of mutual relations of personality, society and state in this industry. Maintenance and principles of human right are described on education. An argumentation is given, that principle of the state participating in education represents positive freedom of individual in the sphere of education and realized through realization the state in the sphere of formation of the basic functions. Thus the duties of the state in the field of education are not limited to the set international acts – they broaden in a national legislation and acts. In the same time, interests of the state, person and society gather in educational relations. Drawn conclusion, that the conducted complex of measures is from the side of the authorized public authorities, first of all Departments of Education and Science of Ukraine, in access of population to education had some positive results. However normatively-legal adjusting of educational process not leans against the clear adjusted conception, but acts are accepted sometimes contradictory, that does not assist forming of the single system of the legal adjusting of the educational system.uk-UA
