С. 61-66.У статті проаналізовано адміністративно-правовий статус керівників територіальних підрозділів патрульної поліції, який обумовлений двома обставинами, перший з яких полягає у специфіці правового статусу Національної поліції України, а другий представляє патрульну поліцію як міжрегіональний територіальний орган з відповідними повноваженнями. Сформульовано розуміння адміністративноправового статусу суб'єкта державного управління, яке пов'язане з визначенням його організаційного стану у системі адміністративно-правових відносин, меж його повноважень та обсягу адміністративної компетенції. Доведено, що у процесі визначення адміністративно-правового статусу керівника територіального підрозділу патрульної поліції вимагає визначення місця та значення патрульної поліції у структурі органів Національної поліції України. Наголошено, що на перший план у процесі визначення адміністративно-правового статусу територіального органу патрульної поліції висувається питання про визначення його компетенції. Надано пропозиції щодо доцільності розподілу повноважень Національної поліції за принципом: загальні, додаткові, спеціальні. Загальні повноваження – це сукупність прав та обов'язків, закріплених у Законі України «Про Національну поліцію». Додаткові повноваження – це окремі права та обов'язки органів (підрозділів) Національної поліції та їх посадових осіб, визначених законодавчими актами, що передбачають реалізацію завдань та функцій поліції за окремими напрямками службової діяльності. Спеціальні повноваження - це сукупність прав та обов'язків територіальних органів (підрозділів) поліції та їх керівників, закріплених у відомчих нормативно-правових актах та актах управління, що передбачають реалізацію завдань та функцій територіального органу (підрозділу) поліції. The article analyzes the administrative and legal status of the heads of territorial divisions of the patrol police, which is determined by two circumstances, the first of which is the specifics of the legal status of the National Police of Ukraine, and the second represents the patrol police as an interregional territorial body with appropriate powers. The understanding of the administrative-legal status of the subject of state administration is formulated, which is related to the determination of its organizational status in the system of administrative-legal relations, the limits of its powers and the scope of administrative competence. It is proven that in the process of determining the administrative and legal status of the head of the territorial unit of the patrol police, it is necessary to determine the place and importance of the patrol police in the structure of the National Police of Ukraine. It was emphasized that in the process of determining the administrative and legal status of the territorial body of the patrol police, the issue of determining its competence is put forward. Proposals were made regarding the expediency of distributing the powers of the National Police according to the principle: general, additional, special. General powers are a set of rights and obligations enshrined in the Law of Ukraine "On the National Police". Additional powers are separate rights and responsibilities of the bodies (units) of the National Police and their officials, defined by legislative acts, which provide for the implementation of tasks and functions of the police in separate areas of official activity. Special powers are a set of rights and responsibilities of territorial bodies (subdivisions) of the police and their leaders, enshrined in departmental regulations and administrative acts, which provide for the implementation of the tasks and functions of a territorial body (subdivision) of the police.
