Дисертація присвячена комплексному вивченню правовідносин у сфері ювенальної юстиції. У публікації вперше у вітчизняній науці здійснено ґрунтовне дослідження теоретично-правових та інституційних адміністративно-правових засад функціонування ювенальної юстиції, як найкращої форми забезпечення прав дитини. У роботі здобуває подальшого розвитку уявлення про праксеологічний вимір ювенальної юстиції як комплексної міжгалузевої діяльності державних органів та громади, та її місце у системі забезпечення прав дітей. Акцентовано увагу, що сучасне бачення ювенальної юстиції, яке виходить за межі кримінального судочинства, обумовлює наявність широкого адміністративно-правового компоненту у функціонуванні цієї форми забезпечення прав дітей. У роботі розглянуто історію розвитку цього соціально-правового інституту (зокрема, зосереджено увагу на адміністративно-правових аспектах), сучасні світові моделі та принципи функціонування ювенальної юстиції, представлено характеристику адміністративно-правового механізму забезпечення функціонування ювенальної юстиції, особливості адміністративно-правового регулювання зазначених правовідносин та інституційного забезпечення основних напрямів (ювенальної превенції (профілактики правопорушень серед дітей), судочинства, реабілітації) тощо. Дисертація підготовлена з урахуванням сучасних міжнародних тенденцій у сфері ювенальної юстиції, базується на чинній нормативно-правовій базі та враховує як вітчизняні, так і закордонні наукові публікації. The abstract of the dissertation contains a structured concise description and presentation of the main results of one of the complex scientific works, in which a systematic block of issues regarding the administrative and legal foundations of the functioning of juvenile justice in the system of ensuring children's rights in Ukraine is investigated at the monographic level. The dissertation is devoted to the comprehensive study of legal relations in the field of juvenile justice. In the publication, for the first time in domestic science, a thorough study of the theoretical-legal and institutional administrative-legal foundations of the functioning of juvenile justice, as the best form of ensuring the rights of the child, was carried out. The work further develops the idea of the praxeological dimension of juvenile justice as a complex interdisciplinary activity of state bodies and the community, and its place in the system of ensuring children's rights. Attention is drawn to the fact that the modern vision of juvenile justice, which goes beyond criminal justice, determines the presence of a broad administrative-legal component in the functioning of this form of ensuring children's rights. The work examines the history of the development of this socio-legal institution (in particular, attention is focused on administrative-legal aspects), modern world models and principles of the functioning of juvenile justice, the characteristics of the administrative-legal mechanism for ensuring the functioning of juvenile justice, the peculiarities of the administrative-legal regulation of the specified legal relations and institutional provision of the main directions (juvenile prevention (prevention of delinquency among children), judicial proceedings, rehabilitation), etc. The dissertation is prepared taking into account modern international trends in the field of juvenile justice, is based on the current legal framework and takes into account both domestic and foreign scientific publications.uk-UA
