Актуальні проблеми вітчизняної юриспруденції. 2021. №6. – С. 67-73.У статті визначено мету державної політики щодо забезпечення прав і свобод осіб з інвалідністю, яка є основоположним елементом будь-якої діяльності, що окреслює та завчасно визначає сутнісно-змістовний компонент механізму її здійснення, виконує спрямовуючу функцію й зумовлює вибір оптимального інструментарію відносно бажаного в майбутньому результату. Запропоновано у межах державної політики щодо забезпечення прав і свобод осіб з інвалідністю розрізняти загальну, стратегічну та функціональну мету. Загальна мета полягає у забезпеченні прав і свобод осіб з інвалідністю, тобто створенні надійних умов для повноцінного здійснення та належної реалізації такими особами своїх прав і свобод, а також їх утвердження, охорона та захист. Стратегічна мета полягає у повноцінному задоволенні потреб осіб з інвалідністю нарівні з іншими громадянами, послідовне створення безбар’єрного середовища, забезпечення комплексної соціальної інклюзії, подолання дискримінації, гарантування належного соціального і правового захисту, розвиток охорони здоров’я, поліпшення умов життєдіяльності тощо. Функціональна мета полягає у попередженні, своєчасному виявленні і вирішенні назрілих проблем у сфері забезпечення прав і свобод осіб з інвалідністю. З’ясовано, що напрями державної політики щодо забезпечення прав і свобод осіб з інвалідністю ґрунтуються на зовнішньополітичних і внутрішньодержавних чинниках, тобто визначаються на основі як міжнародних документів, світової практики і стандартів, так і з урахуванням вітчизняних обставин. Запропоновано напрями державної політики щодо забезпечення прав і свобод осіб з інвалідністю систематизувати шляхом поділу на: 1) напрями на основі забезпечення прав; 2) напрями на основі забезпечення свобод; 3) напрями щодо окремих категорій осіб з інвалідністю; 4) напрями комплексні; 5) напрями, зумовлені актуальними викликами. The article defines the purpose of state policy to ensure the rights and freedoms of persons with disabilities, which is a fundamental element of any activity that outlines and determines in advance the substantive component of the mechanism of its implementation, performs a guiding function and determines the choice of optimal tools. It is proposed to distinguish between general, strategic and functional goals within the framework of the state policy on ensuring the rights and freedoms of persons with disabilities. The overall goal is to ensure the rights and freedoms of persons with disabilities, ie to create reliable conditions for the full exercise and proper exercise of such rights and freedoms by such persons, as well as their establishment, protection and defense. The strategic goal is to fully meet the needs of people with disabilities along with other citizens, consistently create a barrier-free environment, ensure integrated social inclusion, overcome discrimination, ensure adequate social and legal protection, develop health care, improve living conditions and more. The functional goal is to prevent, identify and address pressing problems in the field of ensuring the rights and freedoms of persons with disabilities. It was found that the directions of state policy to ensure the rights and freedoms of persons with disabilities are based on foreign and domestic factors, ie determined on the basis of international documents, world practice and standards, and taking into account domestic circumstances. It is proposed to systematize the directions of the state policy on ensuring the rights and freedoms of persons with disabilities by dividing them into: 1) directions on the basis of ensuring the rights; 2) directions based on ensuring freedoms; 3) directions for certain categories of persons with disabilities; 4) complex directions; 5) areas due to current challenges.
