M.Стаття присвячена проблемам компетенції органів місцевого самоврядування в динаміці децентралізації та професійних можливостей її реалізації. Проаналізовано законодавчі акти які закріплюють компетенцію органів місцевого самоврядування та концепцію реформування місцевого самоврядування. Встановлено відсутність концептуальних змін в повноваженнях органів місцевого самоврядування. Виявлено дискреційні повноваження. Запропоновано застосовувати моніторинг діяльності органів місцевого самоврядування, прийняти низку законів у сфері місцевого самоврядування. The article deals with problematic issues of competence of local self-government bodies. The purpose of the article is to clarify problematic issues of competence of local self-government bodies in the dynamics of decentralization and professional opportunities for its implementation. Philosophical, general scientifi c conceptual approaches, as well as approaches and methods, which are characteristic of modern legal science and were demanded by the problem, became the methodological basis of scientifi c work. During the analysis of views on the understanding of the concept of competence, ambiguity in its interpretation was revealed. As a basis for developing the competence of local selfgovernment as a criterion for the effectiveness of decentralization processes and reforming the sphere of local self-government in general, its structure is taken as the subject of trust (the sphere of social relations where its functioning is determined by the purpose of creation and established by law) and powers (the rights and obligations of the body, which he is endowed with in relation to his objects of knowledge). It was found that councils, executive bodies, village, settlement, and city heads are empowered to resolve issues of local importance. It was investigated that the reform of local self-government did not achieve the optimal distribution of powers between local self-government bodies and executive power bodies. It has been established that the legislator endowed the executive bodies of village, settlement, city councils, village, settlement, and city heads with discretionary powers that can be exercised collectively and individually. Such powers are a corruption-inducing factor in the absence of legal means to ensure the use of discretionary powers in the clearly defi ned scope necessary for proper performance by a person authorized to perform the functions of local self-government. In order to detect violations, it is proposed to use monitoring of compliance of activities with the desired result; to adopt systemic legislation in the fi eld of local self-government, which would correspond to the provisions of the European Charter of Local Self-Government.
