    The monograph presents a theoretical view of the concept of "security environment" as a legal category. A theoretical and legal analysis of the key features of the legislation on national security of Ukraine is offered. A number of aspects of strengthening the security environment were considered, including: overcoming threats to border security; activation of the interaction of state authorities with public formations for the protection of public safety and order; ensuring road traffic safety; prevention of domestic violence; application of criminal law tools to combat certain types of criminal offenses; improving the protection of the security environment on the Internet, etc. Based on the results of the study, proposals for improving the legislation of Ukraine on the creation of a secure environment are substantiated. У монографії представлено теоретичний погляд на поняття «безпекове середовище» як правової категорії. Запропоновано теоретико-правовий аналіз ключових особливостей законодавства про національну безпеку України. Розглянуто низку аспектів щодо зміцнення безпекового середовища, серед яких: подолання загроз прикордонній безпеці; активізація взаємодії органів державної влади з громадськими формуваннями з охорони публічної безпеки і порядку; забезпечення безпеки дорожнього руху; запобігання домашньому насильству; застосування засобів кримінального права для протидії окремим видам кримінальних правопорушень; покращення захисту безпекового середовища у мережі Інтернет, та ін. За підсумками дослідження обґрунтовано пропозиції щодо удосконалення законодавства України з питань формування безпекового середовища.

    Огляд місця події у ході розслідування кримінальних правопорушень проти довкілля

    Статтю присвячено дослідженню специфіки проведення огляду місця події при розслідуванні кримінальних правопорушень проти довкілля та вивченню тактичних рекомендацій щодо проведення цієї слідчої (розшукової) дії. У більшості випадків огляд місця події проводиться невідкладно і до внесення відомостей до Єдиного реєстру досудових розслідувань, коли у працівників досудового розслідування наявні незначні дані про вчинене кримінальне правопорушення проти довкілля і вихідна слідча ситуація вимагає від слідчого проведення необхідних дій з підготовки до огляду місця події і залучення необхідних спеціалістів в галузі екології. Традиційно огляд місця події поділяють на три етапи (підготовчий, робочий, заключний) на кожному з яких слідчий виконує певні процесуальні дії з метою проведення огляду. У ході підготовки до проведення огляду місця події при розслідуванні кримінальних правопорушень проти довкілля, слідчому необхідно залучити до огляду криміналістів та спеціалістів в галузі екології, які під час проведення огляду зможуть надати допомогу у здійсненні фото- та відеозйомки, вилучення слідів протиправних дій, речових доказів, здійснення замірів та відібрання проб, а також надати консультацію з приводу питань, віднесених до їх спеціалізації. До огляду місця події можуть бути залучені екологи, ветеринари, геологи, біологи, інженери, гідрометеорологи, маркшейдери, іхтіологи, єгері, працівники державної екологічної інспекції, працівники суб’єктів господарювання, інспектори рибоохорони, працівники санітарно-екологічної інспекції тощо. Робочий етап огляду місця події у кримінальних правопорушеннях проти довкілля вимагає ретельного вивчення обстановки місця події, детального огляду наявних об’єктів, їх ознак та взаєморозташування, виявлення та фіксації слідів кримінального правопорушення та наслідків, що настали. На заключному етапі результати проведення огляду місця події перевіряються та вносяться до протоколу огляду з яким ознайомлюються поняті та учасники цієї слідчої (розшукової) дії. The article is devoted to the study of the specifics of conducting an inspection of the scene during the investigation of criminal offenses against the environment and to the study of tactical recommendations for conducting this investigative (search) action. In most cases, the inspection of the scene of the incident is carried out immediately and before the entry of information into the Unified Register of Pre-Trial Investigations, when the employees of the pre-trial investigation have insignificant data about the committed criminal offense against the environment and the initial investigative situation requires the investigator to take the necessary actions to prepare for the inspection of the scene of the incident and involve necessary specialists in the field of ecology. Traditionally, the inspection of the scene of the incident is divided into three stages (preparatory, working, final), at each of which the investigator performs certain procedural actions in order to conduct the inspection. In the course of preparing for the inspection of the scene of the incident during the investigation of criminal offenses against the environment, the investigator must involve in the inspection criminologists and specialists in the field of ecology, who during the inspection will be able to provide assistance in taking photos and videos, removing traces of illegal actions, physical evidence, carrying out measurements and taking samples, as well as providing advice on issues related to their specialization. Environmentalists, veterinarians, geologists, biologists, engineers, hydrometeorologists, surveyors, ichthyologists, hunters, employees of the state environmental inspection, employees of economic entities, fish protection inspectors, employees of the sanitary and ecological inspection, etc. may be involved in the inspection of the scene. The working stage of the inspection of the scene of criminal offenses against the environment requires a thorough study of the situation at the scene of the incident, a detailed examination of the existing objects, their signs and their mutual location, the identification and recording of traces of the criminal offense and the resulting consequences. At the final stage, the results of the inspection of the scene of the incident are entered into the inspection protocol, which is read by witnesses and participants of this investigative (search) action.
