    У статті розглядаються особливості кримінальної відповідальності за незаконні дії зі спеціальними технічними засобами негласного отримання інформації. Звертається увага на доцільність виключення спеціальних технічних засобів негласного отримання інформації з переліку предметів контрабанди. Актуалізовано криміналізацію незаконного використання спеціальних технічних засобів негласного отримання інформації та незаконного розроблення, виготовлення, постачання спеціальних технічних засобів негласного отримання інформації та виключення статті 359 із Кримінального кодексу України. The article examines the specifics of criminal liability for illegal actions with special technical means of secretly obtaining information. It is emphasized that the actions described in Article 359 of the Criminal Code of Ukraine “Illegal acquisition, sale or use of special technical means of obtaining information” encroach on various objects of criminal law protection. Thus, the illegal purchase or sale of special technical means of covertly obtaining information creates a threat of harm or harm to economic activity, since such actions are carried out on the basis of a license obtained.

    Правове регулювання медичного забезпечення транспортної безпеки

    Вертикальна структура транспортної правової системи базується на ієрархії нормативно-правових актів. Конституція України, основний закон держави, є джерелом транспортного права та правовою основою для його розвитку. Цивільний кодекс України та Господарський кодекс є, безперечно, важливими джерелами транспортного права. Основоположним нормативно-правовим актом транспортного законодавства є Закон України «Про транспорт», який закладає правові, економічні та соціальні основи діяльності транспорту. Окрім того, транспортна діяльність регулюється законами України «Про дорожній рух», «Про залізничний транспорт», «Про функціонування єдиної транспортної системи України в особливий період» тощо. The vertical structure of the transport legal system is based on the hierarchy of normative legal acts. The Constitution of Ukraine, the fundamental law of the state, is the source of transport law and the legal basis for its development. The Civil Code of Ukraine and the Commercial Code are undoubtedly important sources of transport law. The fundamental normative legal act of transport legislation is the Law of Ukraine “On Transport”, which lays down the legal, economic and social foundations of transport activities. In addition, transport activities are regulated by the Laws of Ukraine “On Road Traffic”, “On Railway Transport”, “On the Functioning of the Unified Transport System of Ukraine in a Special Period”, etc. Unfortunately, Ukraine ranks among the first in Europe in terms of road injuries. Every year we lose more than 3,5 thousand people in road accidents (hereinafter referred to as RTA), and 10 times more are injured. The Law of Ukraine “On Road Traffic” defines the legal and social foundations of road traffic in order to protect the life and health of citizens, create safe and comfortable conditions for road users and protect the environment. According to Article 45 of the said Law, medical examination and review of candidate drivers and drivers of vehicles is carried out in order to determine the ability of candidate drivers and drivers to safely drive vehicles. The said review includes: preliminary, periodic, variable pre-trip and post-trip examinations, as well as unscheduled examinations due to necessity. The frequency of examinations, the procedure for their implementation and sending drivers for unscheduled examinations are determined by a joint act of the central executive body responsible for the formation of state policy in the field of health care, and the Ministry of Internal Affairs of Ukraine.
