Про значення загальної декларації прав людини в процесі формування стандартів соціально-економічних прав

У статті розкрито значення ЗДПЛ з початку її створення в справі формування міжнародних стандартів інституту соціально-економічних прав людини. Досліджено історичний аспект їх концептуального теоретико-правового обґрунтування, включаючи й участь у цьому процесі українських учених- правознавців. Виокремлено права другого покоління та показано необхідність їх дотримання як обов’язок держави, що набуває парадигмального значення в розвитку її взаємодії з громадянином. One of the major tasks today is the protection of socio-economic rights of the citizens of our country that makes the items of sources and history of becoming and forming of these rights urgent. In this process Universal Declaration of Human Rights of 1948 year is of great significance where international standards of the institute of socio-economic rights had been formulated. Many of socio-economic rights proclaimed by this document were known to humanity long time ago but they were not concerted and recognized by the international community. At the same time only those of them were included into Declaration which began to acquire international acknowledgment between ХIХ-ХХ centuries and got afterwards the name of rights as "the second generation". Universal Declaration of Human Rights became the first international document that summed up the lengthy fight of humanity against injustice and respect of human dignity. It could unite fundamental human rights in their general system and laid the foundation for the creation of other international documents in this sphere, extended the catalogue of human rights, formed the basis for the formation of the mechanism of realization of fundamental human rights as well as by international means. The article considers theoretical, legal and conceptual bases of Declaration which have historical substantiations in a number of documents inaccessible before for the wide circle of soviet scientists. Research of this items allows to establish the sources of ideas of substantiation of socio-economic rights, for example, in the "Atlantic charter" (1941) and other documents. Participating of the Ukrainian jurisprudents in such work was also marked, it was reported about this fact in soviet time but it was not reported about its content. Rights of the second generation are distinguished in their logical unity and general morally-philosophical context with rights of the first generation. There follows a conclusion about the necessity of their observance as the state duties that gets a paradigmatic significance in the development of its interaction with a citizen.
