dc.description.abstractДосліджено роль медіації у врегулюванні сімейних спорів в Україні та визначено специфіку таких конфліктів. Проаналізовано значення адвокатів у медіативних процедурах, а також правові, соціальні та психологічні аспекти застосування медіації. Показано, що інтеграція адвокатської діяльності у позасудові процедури сприяє ефективному досягненню взаємоприйнятних рішень, зменшенню навантаження на суди та підвищенню якості правничої допомоги. Дослідження підкреслює необхідність розвитку спеціалізованих методик для адвокатів і адаптації міжнародного досвіду до українських умов. In the contemporary context of the development of Ukraine’s legal system, mediation is becoming an important tool for alternative dispute resolution, signifi cantly reducing the burden on the judicial system and enhancing the effi ciency of confl ict resolution. Mediation is particularly relevant in family disputes, which are characterized by a high level of emotional tension, asymmetry of power between the parties, the need to consider the interests of children, and the multi-party involvement of family members. The advantages of mediation lie in its ability to provide a fl exible, voluntary, and confi dential process aimed at reaching mutually acceptable solutions that consider not only legal aspects but also the psychological, social, and moral factors of the confl ict. The relevance of this study is determined both by the signifi cant burden on courts and the need to develop dispute resolution mechanisms capable of ensuring a stable and constructive outcome without formal judicial intervention. Statistical data indicate that family disputes occupy a leading position in the structure of civil proceedings in Ukraine, and the duration of their consideration often exceeds reasonable limits, negatively affecting the realization of the rights and interests of the parties, especially children. In this context, mediation serves as an effective means of prompt and fl exible confl ict resolution, taking into account the specifi c nature of family legal relationships. Particular attention is paid to the role of lawyers in the mediation process. They not only represent the interests of clients in court proceedings but also actively contribute to the development of mutually acceptable solutions by analyzing the confl ict situation, modeling the negotiation process, and predicting possible scenarios for dispute development. Thus, mediation in family disputes serves as an effective mechanism for confl ict resolution, capable of taking into account emotional, psychological, and social factors that go beyond formal legal regulation. Prospects for further research include the development of specialized methodologies for lawyers, the analysis of the effectiveness of mediation procedures in different categories of family disputes, and the comparison of national and international experience to optimize practices and enhance the social and legal adequacy of family confl ict resolution.
