dc.description.abstractМетою статті є дослідження особливостей правового регулювання діяльності регіональних митниць в умовах воєнного стану в Україні з урахуванням євроінтеграційних законодавчих норм з визначенням напрямків, які потребують подальших змін. Досліджено негативні чинники впливу на роботу регіональних митниць, які породжено воєнними діями в Україні, що спровокувала російська федерація. Розкрито рольовий аспект необхідності та доцільності впровадження правових норм Європейського Союзу в законодавчі регулятори, які регламентують діяльність регіональних митниць. Автори розкривають змістовність законодавчих регуляторів, які базуються на правових нормах Європейського Союзу та фактично адаптовані в Україні останнім часом в діяльності митних органів, звертають увагу на зміни, які торкнулися статей Митного кодексу України в контексті врегулювання процедури складання митних декларацій на товари, які класифікуються у межах однієї товарної позиції згідно з УКТ ЗЕД; приєднання України до Конвенції про процедуру спільного транзиту; питання реалізації концептуальних напрямів реформування системи органів, що реалізують державну митну політику. За результатами досліджень автори дійшли висновку, що назріла нагальна потреба у впровадженні принципу професіоналізму посадовим особам митних органів, від яких залежить дієвість та якість адаптування реформаторських дій законодавця. Автори вважають, не дивлячись на воєнні дії в Україні, потрібно продовжити адаптувати правові норми Європейського Союзу в роботі регіональних митниць України за напрямками, які торкаються функціонування митних складів та лабораторій з врахуванням процедур проведення митного контролю. Результат упровадження законодавчих ініціатив мав спричинити зменшення податкового навантаження на малий та середній бізнес, як мінімум, на період дії воєнного стану; формування належної системи захисту національного ринку від правопорушень, які активізувалися в процесах перевезення продукції через митні кордони України, від випадків появи неякісних товарів чи послуг, які представлено в митних процедурах; призупинення невиправданих дій дер жавних службовців, які в межах власних повноважень мають вплив на ефективність митного контролю та здатні знизити результативність фіскальної політики за умови нехтування працівниками своїх функціональних обов’язків. The purpose of the article is to study the peculiarities of the legal regulation of the activities of regional customs in the conditions of martial law in Ukraine, taking into account the European integration legislative norms and identifying directions that require further changes. The negative factors of influence on the work of regional customs, which were caused by military actions in Ukraine provoked by the Russian Federation, were studied. The role aspect of the necessity and expediency of the introduction of the legal norms of the European Union into the legislative regulators that regulate the activities of regional customs is revealed. The authors reveal the content of the legislative regulations, which are based on the legal norms of the European Union and actually adapted in Ukraine recently in the activities of customs authorities, draw attention to the changes that affected the articles of the Customs Code of Ukraine in the context of regulating the procedure for drawing up customs declarations for goods classified within one commodity item according to the UCT of the ZED; accession of Ukraine to the Convention on the common transit procedure; the issue of implementation of the conceptual directions of reforming the system of bodies implementing the state customs policy. According to the results of the research, the authors came to the conclusion that there is an urgent need to introduce the principle of professionalism to the officials of the customs authorities, on which the effectiveness and quality of adaptation of the legislator's reforming actions depends. The authors believe that, despite the military actions in Ukraine, it is necessary to continue to adapt the legal norms of the European Union in the work of the regional customs of Ukraine in areas that affect the functioning of customs warehouses and laboratories, taking into account the procedures of customs control. The result of the implementation of legislative initiatives was to reduce the tax burden on small and medium-sized businesses for at least the period of martial law; the formation of an appropriate system of protection of the national market against offenses that have become active in the process of transporting products across the customs borders of Ukraine, from cases of the appearance of low-quality goods or services that are presented in customs procedures; suspension of unjustified actions of civil servants who, within their own powers, have an impact on the effectiveness of customs control and are able to reduce the effectiveness of fiscal policy if the employees neglect their functional duties.
