dc.description.abstractУ статті досліджується інститут зловживання процесуальними правами у цивільному процесі України з акцентом на його прояви у сімейних правовідносинах. Проаналізовано теоретичні підходи до розуміння зловживання правом, законодавчі засади його регулювання та практику Верховного Суду. Особливу увагу приділено сімейним спорам щодо поділу майна, аліментних зобов’язань та визначення місця проживання дитини, у яких процесуальні права нерідко використовуються всупереч їх соціальному призначенню. Обґрунтовано необхідність формування чітких критеріїв оцінки добросовісності процесуальної поведінки сторін. The article provides a comprehensive analysis of the problem of abuse of procedural rights in civil proceedings of Ukraine through the prism of family legal relations. It is substantiated that family disputes, due to their heightened emotional nature, duration, and close connection with personal non-property and property rights, constitute one of the most vulnerable categories of cases in terms of bad faith procedural behavior of the parties. The study examines the main doctrinal approaches to defi ning abuse of procedural rights as a special type of civil procedural offense and as a form of exercising a subjective right contrary to its purpose and social function. The article analyzes the regulatory framework for preventing abuse of procedural rights in civil proceedings in Ukraine, in particular through the principles of good faith, adversarial proceedings, and proportionality. Special attention is paid to the analysis of the case law of the Supreme Court, which has formulated approaches to identifying signs of abuse of procedural rights in family disputes concerning the division of marital property, determination of a child’s place of residence, and recovery or reduction of alimony. It is emphasized that abuse of procedural rights in such cases often manifests itself in the use of procedural mechanisms to achieve extra-procedural goals, including evasion of the fulfi llment of property obligations or the creation of obstacles to the exercise of the rights of other participants in legal relations. The article concludes that there is a need to develop unifi ed criteria for assessing the good faith of procedural behavior of the parties in family disputes and to strengthen the role of the court in preventing abuse of procedural rights in order to ensure fairness, effectiveness, and a proper balance of interests in civil proceedings.
