Анотація
У статті проаналізовано особливості функціонування цивільного судочинства в Україні в умовах правового режиму воєнного стану. Розглянуто нормативні та організаційні механізми забезпечення безперервності правосуддя, зміну територіальної підсудності, проблеми доступу до доказів, дотримання процесуальних строків і відновлення втрачених судових проваджень. Обґрунтовано необхідність адаптації процесуальних процедур до умов воєнного часу з урахуванням практики Верховного Суду та позицій науковців.
The article is dedicated to the study of the peculiarities of civil proceedings in Ukraine under martial law. It analyzes the legislative and organizational measures implemented to ensure the continuity of justice, in particular the provisions of the Law of Ukraine “On the Legal Regime of Martial Law,” amendments to the Law “On the Judiciary and the Status of Judges,” as well as the decisions of the Council of Judges of Ukraine regarding urgent measures in connection with military aggression. It has been established that even with existing regulatory mechanisms, civil proceedings face a number of specifi c problems: diffi culties in accessing evidence, delays in its submission, limited communication with witnesses and experts, temporary suspension of court activities, changes in territorial jurisdiction, and loss of court materials due to hostilities or occupation of territories.
The practice of restoring court proceedings and reinstating missed procedural deadlines is analyzed, emphasizing the importance of detailed documentation of the reasons for failing to comply with procedural actions. Particular attention is paid to the use of remote court proceedings as a tool for adapting the justice system to martial law conditions, while noting its limitations in cases of power outages, communication failures, or lack of access to physical documents. Based on the analysis of legislative provisions and judicial practice, promising directions for the development of civil proceedings in emergency situations are identifi ed, including the comprehensive integration of remote technologies with fl exible procedural regulation, prompt verifi cation of the validity of missed deadlines, electronic exchange of evidence, and clear rules for evacuation and preservation of court materials. The proposed approach allows enhancing the resilience of the judicial system and ensuring access to justice for citizens and legal entities even under conditions of martial law.
