dc.description.abstractСтаттю присвячено розгляду питання про місце справедливості в низці засад кримінального провадження та визначенню ролі справедливості як основного критерію прийняття кримінальних процесуальних рішень судом під час кримінального провадження. Розглянуто взаємозв’язок справедливості в кримінальному провадженні з народовладдям. Проведено аналогію між справедливістю й народовладдям у кримінальному провадженні України та звичаєвою справедливістю й народовладдям у правовій системі Японії. The article deals with the matters of the place of justice in a number of principles of criminal proceedings, as well as the role of justice as the main criterion for adoption of criminal procedural decisions by a court in the course of criminal proceedings. The interrelation of justice in criminal proceedings with democracy is considered. The analogy is drawn between justice and democracy in criminal proceedings of Ukraine and cultural justice and democracy in the legal system of Japan. First of all, it should be recognized that the principle of justice in criminal proceedings it is not so much a procedural ambush, it is that a moral factor necessary for the criminal process, as the principle of justice should be a filter to mechanisms for implementation of not only the tasks of criminal proceedings, but also decision-making, in particular, in certain cases and through the study of public opinion.
