О.Статтю присвячено дослідженню проблемно-дискусійних питань тлумачення оперативної закупки. Проаналізовано підходи науковців до розуміння сутності цієї негласної слідчої (розшукової) дії. Визначено притаманні їй ознаки. У контексті дослідження запропоновано вважати, що оперативна закупка – це негласна слідча (розшукова) дія, що має структурну характеристику тактичної операції щодо придбання або отримання, у тому числі безоплатно, у фізичних та юридичних осіб зброї та бойових припасів, обіг яких обмежений чи заборонений, з метою викриття і документування уповноваженими оперативними підрозділами факту вчинення незаконного поводження з такими об’єктами озброєння та особи, яка його вчинила. Окремо визначено тактичні завдання, що вирішуються під час проведення оперативної закупки. Розкрито відповідний алгоритм дій. Акцентовано, що слідчий відіграє ключову роль у сприянні ефективній реалізації організаційно-підготовчих заходах; складані плану з визначенням окремих тактичних завдань; забезпечує якісну взаємодії з уповноваженими оперативними підрозділами. Проведення оперативної закупки самим слідчим або за його участі в ній тактично є не виправданим. The process of transforming the current criminal procedural legislation defines it as one of the progressive fields of law in Ukraine, which incorporates European experience in combating crime and the enduring nature of Ukrainian legal practice. In the conditions of war, the transformation process has gained greater significance, particularly in the sphere of combating illegal trafficking of weapons. Currently, the detection and disclosure of cases involving illegal handling of weapons and ammunition require scientific clarification of tactics for conducting specific investigative (search) actions, specifically operational procurement as an effective method for identifying individuals engaged in illegal trafficking (distribution) of weapons and documenting their criminal activities. In this regard, problematic and controversial issues regarding the interpretation of operational procurement are outlined. Approaches by scholars to understanding the essence of this covert investigative (search) action are analyzed, and its inherent characteristics are identified. In the context of the study, it is proposed to consider operational procurement as a covert investigative (search) action that has the structural characteristic of a tactical operation to acquire or obtain, including free of charge, weapons and ammunition from individuals or legal entities, the circulation of which is restricted or prohibited, with the aim of exposing and documenting the fact of illegal handling of such weapons and identifying the person who committed it, by authorized operational units. Specific tactical tasks solved during the conduct of operational procurement are separately defined, and the corresponding algorithm of actions is disclosed. It is emphasized that the investigator plays a key role in supporting effective implementation through organizational and preparatory measures; developing a plan with specific tactical tasks; and ensuring quality cooperation with authorized operational units. The involvement of the investigator in conducting operational procurement, either directly or through participation, is tactically unjustified.Документ Виявлення та розкриття організованої злочинної діяльності: сучасні проблеми та перспективи(Донецький державний університет внутрішніх справ, 2024) Волобоєв А. О....Людвиченко О. О.Наукова робота складається зі вступу, основної частини, висновків, списку використаних джерел (65 найменування). Загальний обсяг наукової роботи становить 140 сторінок, з яких основного тексту – 101 сторінка. В роботі є 5 додатків. Об’єктом дослідження виступають суспільні відносини, які визначають особливості протидії організованій злочинності в умовах правового режиму воєнного стану. Метою дослідження є розгляд теоретичних, правових, організаційних та тактичних засад протидії організованій злочинності підрозділами стратегічних розслідувань в умовах правового режиму воєнного стану та визначення шляхів удосконалення даної діяльності. Методологічну основу складає загальний діалектичний метод наукового пізнання діяльності підрозділів стратегічних розслідувань, відповідно до якого визначено суб’єктивні та об’єктивні аспекти реалізації суспільних відносин в означеній сфері. Наукова новизна одержаних результатів полягає в розгляді проблем та перспектив виявлення та розкриття організованої злочинної діяльності. Основні положення та висновки наукової роботи оприлюднені на Міжнародній науково-практичній конференції «Протидія організованій злочинності і корупції в умовах збройного конфлікту: досвід та перспективи» з нагоди 5-річчя створення Департаменту стратегічних розслідувань НПУ». Результати наукової роботи можуть бути використані у науково-дослідній сфері, правотворчості, правозастосовній діяльності та в освітньому процесі. Проведене дослідження є завершеною працею, в якій було сформульовано авторське бачення організаційно-методологічній парадигмі оперативнорозшукового забезпечення протидії організованій злочинної діяльності. Завершенням наукового дослідження є підготовка відповідних методичних рекомендацій. The scientific work consists of an introduction, the main part, conclusions, a list of used sources (65 titles). The total volume of the scientific work is 140 pages, of which 101 pages are the main text. There are 5 applications in the work. The object of research is social relations, which determine the specifics of combating organized crime in the conditions of the legal regime of martial law. The purpose of the study is to consider the theoretical, legal, organizational and tactical foundations of combating organized crime by strategic investigation units in the conditions of the legal regime of martial law and to determine ways to improve this activity. The methodological basis is the general dialectical method of scientific knowledge of the activity of strategic investigation units, according to which the subjective and objective aspects of the implementation of social relations in the specified sphere are determined. The scientific novelty of the obtained results lies in the consideration of problems and prospects of detection and disclosure of organized criminal activity. The main provisions and conclusions of the scientific work were made public at the International Scientific and Practical Conference "Combating Organized Crime and Corruption in the Conditions of Armed Conflict: Experience and Prospects" on the occasion of the 5th anniversary of the establishment of the Department of Strategic Investigations of the NPU. The results of scientific work can be used in the scientific research field, lawmaking, law enforcement activities and in the educational process. The conducted research is a completed work in which the author's vision of the organizational-methodological paradigm of operational-investigative support for combating organized criminal activity was formulated. Completion of scientific research is the preparation of appropriate methodological recommendations.
