Документ Професійна діяльність журналіста як елемент віктимологічної характеристики потерпілого від злочинів проти журналістів(Луганський державний університет внутрішніх справ імені Е.О. V.У статті досліджено питання професійної діяльності журналіста як елемента віктимологічної характеристики потерпілого від злочинів проти журналістів у рамках криміналістичної характеристики таких злочинів. Розглянуто та класифіковано зв'язки між жертвою та злочинцем, вивчено вплив професійної діяльності журналіста на такі зв'яки, механізм формування кримінальної спрямованості злочинця та слідову картину злочину. На основі віктимологічного аналізу автор запропонував визначення поняття журналіста для потреб КК України. The article investigates the question of journalistic activities as а part of victimological characteristics of victims of crimes against journalists within the criminalistic characteristics of crimes. Studied the statistics of independent media organizations on the number of criminal attacks against journalists in Ukraine over the past four years. Investigated the opinions of scientists about the place of victimological personal data of the victim in forensic characteristics of crimes. Determined that the professional activity of a journalist is the main feature of victimological characteristics of the victim of a crime against a journalist. Studied the legal definitions of journalist, stated opinion on their imperfections. According to the author, the mandatory requirement to confirm the status of the journalist or his identity to the media in a note to Article 345-2 of Criminal Code of Ukraine significantly restricts the right for protection of certain categories of people. In particular, the author speaks about bloggers, photo- video- correspondents and other persons, who do not have special licenses, perform professional journalistic activities and can become victims of crime because of it. Considered and classified communications between the victim and the offender in the mechanism of crimes against journalists. The influence of the professional activities of a journalist on such communications, on the mechanism of forming a criminal mind of the offender and on a trace picture of crime is studied. Based on the victimological analysis, author proposed definition of a journalist for the purposes of the Criminal Code of Ukraine.Документ Значення віктимологічних даних для побудови типових криміналістичних версій(Луганський державний університет внутрішніх справ імені Е. При цьому, на початковому етапі розслідування обсяг доступного слідчому для пізнання фактичного матеріалу досить часто є недостатнім і обмежується інформацією щодо одного чи двох елементів криміналістичної характеристики злочинного діяння. У таких випадках видається доречним звернення до кореляційних зв’язків між відомими елементами криміналістичної характеристики та тими, які ще потрібно з’ясувати, тобто до побудови криміналістичних версій. The aim of cognition at investigation of crime is finding out all circumstances of criminal event. Thus, on the initial stage investigation is a volume accessible to the investigator for cognition of actual material often enough is insufficient and limited to information on one or two elements of criminalistics description of criminal act. The author defines and substantiates legal and factual grounds and procedural order of acknowledgment of a journalist as a victim of this category of crimes. Розглянуто особливості огляду трупу, визначено негативні обставини, встановлення яких при огляді може свідчити про намагання злочинця приховати злочин шляхом інсценування. The article is devoted to the study of the tactics of inspection of the crime scene during investigation of infringements on life and health of journalists. Recommendations on the actions of the investigator at each stage of the conduct of the named investigative (search) action are offered. The expediency of using modern technical means, including cartographic services on the Internet, during the preparation for such inspection is substantiated. The author emphasizes the benefits of involving the victim in the inspection of the crime scene, if the state of health of the latter permits. The investigator is recommended to organize the enclosing of the target territory of inspection with the help of the operational staff and to remove unauthorized persons immediately upon arrival at the place of the event and determining the boundaries of the inspection. In cases where the enclosing of a large area is difficult, it is advisable, through a surface survey, to separate the squares (cells of the accumulation of traces of the crime) and arrange a simultaneous review of such squares by the participants in the investigation team. Attention is drawn to the need to instruct the operational staff to find and interview eyewitnesses simultaneously with interrogation. The objects that can be found within the inspection of the crime scene during investigation of infringements on life and health of journalists are listed. The peculiarities of the inspection of the corpse are considered. The author examines the essence of inspection as a procedural action and suggests defining the inspection of objects as an overt investigative (search) action, which involves the direct purposeful perception by an authorized person of the characteristics of a specific material object with the aim of obtaining or verifying information relevant to criminal proceedings.
