Yu.Статтю присвячено дослідженню питань визначення суб’єктів адміністративних проступків для правильної кваліфікації порушень правил дорожнього руху його учасниками. З’ясовано причини скоєння дорожньо-транспортних пригод на території України в 2023 році, що призвели до загибелі та травмування людей. Проведено аналіз регуляторних актів щодо визначення учасників дорожнього руху та їх співвідношення із суб’єктами адміністративних правопорушень правил дорожнього руху. Констатовано, що для правильної кваліфікації адміністративних проступків потрібне узгодження деяких положень правових норм. Аргументовано необхідність надання тлумачення терміна «погонич тварин» та визначення правового статусу особи, яка керує гужовим транспортом, як учасника дорожнього руху. Визначено, що тлумачення терміна «пішохід» у Правилах дорожнього руху не відповідає дефініції, закріпленій у Законі України «Про дорожній рух» та підлягає узгодження з нею. Наголошено на дуалізмі правового статусу особи, яка рухається в кріслі колісному, залежно від місця її розташування на дорозі під час руху, що породжує обов’язок виконання правил для пішоходів або велосипедистів. Акцентовано увагу на особливості кваліфікацій діянь цієї категорії учасників дорожнього руху залежно від за значених факторів. Доведено необхідність визначення правового статусу особи, яка керує легким персональним електричним транспортним засобом, та запровадження адміністративної відповідальності за проступки, вчинені цими особами. Аргументовано, що визначення суб’єктів адміністративних правопорушень у сфері безпеки дорожнього руху є невід’ємним елементом характеристики складу адміністративного проступку, а тому законодавство про адміністративну відповідальність потребує якнайшвидшого осучаснення та уніфікації з нормами спеціальних законів, що дають визначення учасників дорожнього руху та їхнього правового статусу. The article is devoted to the study of the issues of determining the subjects of administrative offenses for the correct qualification of violations of traffic rules by its participants. The reasons for the commission of road accidents on the territory of Ukraine in 2023, which led to the death and injury of people, were found out. An analysis of regulatory acts on the definition of road traffic participants and their correlation with the subjects of administrative violations of traffic rules was conducted. It was found that for the correct qualification of administrative offenses, coordination of some provisions of legal norms is required. The need to provide an interpretation of the term “animal driver” and determine the legal status of a person driving a horse-drawn vehicle as a road traffic participant is argued. It was determined that the interpretation of the term “pedestrian” in the Traffic Rules does not correspond to the definition enshrined in the Law of Ukraine “On Road Traffic” and is subject to coordination with it. The duality of the legal status of a person moving in a wheelchair, depending on their location on the road during movement, is emphasized, which gives rise to the obligation to comply with the rules for pedestrians or cyclists. The attention is focused on the peculiarities of the qualifications of the actions of this category of road users depending on the specified factors. The necessity of determining the legal status of a person driving a light personal electric vehicle and the introduction of administrative liability for offenses committed by these persons is proven. It is argued that the definition of subjects of administrative offenses in the field of road safety is an integral element of the characteristics of the composition of an administrative offense, and therefore the legislation on administrative liability requires the earliest possible modernization and unification with the norms of special laws that define road users and their legal status.Документ Правова визначеність статусу окремих учасників дорожнього руху в сучасному законодавстві України(Гельветика, Донецький державний університет внутрішніх справ, 2024) Червінчук А. O.Стаття присвячена дослідженню правової визначеності статусу окремих учасників дорож нього руху, зокрема, осіб, які керують легким персональним електричним транспортним засобом, за чинним законодавством України та проєктами законодавчих актів, що мають регулювати суспільні відносини у сфері забезпечення безпеки дорожнього руху. Проаналізовано законопроєкт «Про внесення змін до Кодексу України про адміністративні правопорушення та інших законодавчих актів щодо деяких аспектів підвищення безпеки учасників дорожнього руху» № 10441 від 29 січня 2024 року, яким визначається правовий статус осіб, які керують легким персональним транспортним засобом, а саме закріплюються права та обов’язки як учасників дорожнього руху, а також вирішено питання щодо можливості притягнення зазначених осіб до адміністративної відповідальності за правопорушення у сфері забезпечення дорожнього руху. На основі проведеного аналізу проєкту Закону та чинного законодавства України у сфері безпеки дорожнього руху, надано пропозиції щодо змісту правового статусу осіб, які керують персональним електричним транспортним засобом. The article is devoted to the study of the legal certainty of the status of individual road users, in particular, persons who drive a light personal electric vehicle, under the current legislation of Ukraine and draft legislative acts that are to regulate public relations in the field of ensuring road safety. The draft law “On Amendments to the Code of Ukraine on Administrative Offenses and Other Legislative Acts Regarding Some Aspects of Improving the Safety of Road Users” No. 10441 of January 29, 2024 was analyzed, which determines the legal status of persons who drive a light personal vehicle, namely, enshrines the rights and obligations as road users, and also resolves the issue of the possibility of bringing these persons to administrative liability for offenses in the field of ensuring road traffic. Based on the analysis of the draft Law and the current legislation of Ukraine in the field of road safety, proposals are made regarding the content of the legal status of persons who drive a personal electric vehicle.Документ Influence of Police Authorities and Units on Transport Safety in the European Union Countries(International Journal of Computer Science and Network Security, 2022) Chervinchuk A. The globalization processes confirm the study's relevance, provoking population mobility and the need to increase freight traffic. The study aims to identify the factors that affect road safety and the activities of the police and the EU transport safety units. An empirical analysis using factor analysis, correlation analysis, and general scientific methods of cognition were carried out to achieve the goal. The analysis results found that the number of police officers affects road safety, but not in all countries, which confirms the importance of other factors. Based on the analysis results of the scientific literature, the factors affecting transport safety are legislative regulation, the use of innovative technologies, transport infrastructure, geography, and psycho-physical and emotional drivers factors.
