П.У тезах розглядається застосування штрафних балів як нового виду адміністративного стягнення, введеного в Україні у 2015 році за правопорушення у сфері безпеки дорожнього руху, зафіксовані в автоматичному режимі. Автором аналізується доцільність та дієвість цієї "списуючої" системи. Серед позитивних аспектів запровадження штрафних балів ним визнаються: їх ефективність як превентивного у та засобу правового виховання водіїв; спрощення процесу фіксації та оформлення адміністративних правопорушень; зменшення можливості корупційних проявів у провадженні. Серед негативних питань виділяються: практична відсутність чіткого та зрозумілого механізму притягнення до адміністративної відповідальності, окрім положень Кодексу України про адміністративні правопорушення; порушення принципів адміністративної відповідальності (презумпції невинуватості та об’єктивної істини), оскільки відповідальність несуть власники транспортних засобів (юридичні та фізичні особи), хоча правопорушення може вчинити особа, яка не є власником. Автором підсумовується, що впровадження системи штрафних балів є прогресивним заходом, який відповідає сучасним процесам державотворення та євроінтеграції в Україні, проте потребує термінового вироблення чіткого механізму притягнення до відповідальності для усунення недоліків. The abstract examines the application of penalty points as a new type of administrative penalty introduced in Ukraine in 2015 for road safety offenses recorded in automatic mode. The author analyzes the expediency and effectiveness of this "point deduction" system. Among the positive aspects of introducing penalty points, the author recognizes: their effectiveness as a preventive measure and a means of legal education for drivers; the simplification of the process for recording and documenting administrative offenses; and the reduction of opportunities for corruption in the proceedings. Among the negative issues highlighted are: the practical absence of a clear and understandable mechanism for imposing administrative liability, apart from the provisions of the Code of Ukraine on Administrative Offenses; the violation of the principles of administrative liability (presumption of innocence and objective truth), since the owners of vehicles (legal entities and individuals) bear the liability, even though the offense may have been committed by a person who is not the owner. The author concludes that the implementation of the penalty point system is a progressive measure that aligns with current state-building and European integration processes in Ukraine, but requires the urgent development of a clear mechanism for imposing liability to eliminate existing shortcomings.Документ Використання нових технологічних інструментів у запобіганні та протидії домашньому насильству та насильству за ознакою статі: зарубіжний та національний досвід(2022) Мердов С. На спортивно-оздоровчу діяльність держава покладає відповідальність за розв’язання проблем соціального комплексу, невіддільно пов’язаного зі станом і зміцненням здоров’я дітей, підлітків, студентства, робітників підприємств та установ України. Окрім цього, соціально зумовлена потреба формування здоров’я людини повинна трансформуватися в культурну, у прагнення до фізичного вдосконалення. Політичні, соціально-економічні зміни, наслідки пандемії воєнний стан в Україні вимагають пошуку нових методів, засобів, прийомів для вирішення освітньо-прикладних завдань у закладах вищої освіти. Здійснено аналіз особливостей організації спортивно-оздоровчої діяльності студентів, яку у дослідженні визначаємо як систему заходів масового спорту та фізичного виховання, спрямованих на створення умов для забезпечення оптимальної рухової активності кожного студента за місцем навчання, проживання та відпочинку для зміцнення здоров’я й профілактики захворювань, активного дозвілля. Обґрунтовано доцільність впровадження нових підходів у реалізації освітнього процесу студентів у позааудиторній діяльності: чітко структурувати роботу студентів і викладачів у позааудиторний час; розширити секції з видів спорту, які подобаються студентам; залучати студентів до волонтерської роботи; проводити спортивно-розважальних та військово патріотичні конкурси та свята; співпрацювати з місцевими дитячо-юнацькими спортивними школами; залучати практичних працівників до проведення бінарних занять, тренувань тощо. The article carries out a theoretical analysis of sports and health and physical culture activities of student youth in extracurricular activities. Sports and physical activity of an individual is an inseparable component of the national history and culture of the people, it contributes to the harmonious development of a person, his achievement of longevity, and the formation of his culture of health. The state assigns the responsibility for solving the problems of the social complex, which is inseparably connected with the condition and strengthening of the health of children, adolescents, students, workers of enterprises and institutions of Ukraine, to sports and health activities. In addition, the socially determined need for the formation of human health should be transformed into a cultural one, into a desire for physical improvement. Political, socio-economic changes, the consequences of the pandemic, and the military situation in Ukraine require the search for new methods, means, techniques for solving educational and applied tasks. An analysis of the peculiarities of the organization of sports and recreational activities of students was carried out, which in the study is defined as a system of mass sports and physical education activities aimed at creating conditions for ensuring optimal motor activity of each student at the place of study, living and recreation for health promotion and disease prevention. active leisure. П.Статтю присвячено аналізу зарубіжного та національного досвіду використання спортивного потенціалу в межах реалізації заходів концепції «Community Policing», його узагальненню та визначенню подальших напрямів діяльності в цій сфері. Зроблено висновок, що використання спортивного потенціалу підрозділами поліції в межах реалізації заходів концепції «Community Policing» є важливим інструментом профілактичного впливу, засобом створення довірливих відносин між населенням та поліцією, а також популяризації здорового способу життя, відповідального ставлення до здоров’я. Автором запропоновано напрями вдосконалення діяльності поліції в цій сфері. With the introduction of new approaches to the activities of the National Police of Ukraine at the present stage of its development, the implementation of measures of the "Community Policing" concept, the issues of finding new ways, activities of interaction between the police and society are of particular relevance, which is due to the development of a new philosophy of police activity. Given this, the article is devoted to the analysis of foreign and national experience in the use of sports potential in the framework of the implementation of the activities of the "Community Policing" concept, its generalization and determination of further areas of activity in this area. It analyzes the successful practices of the implementation of joint sports projects by the police and the population in such countries as the United States of America, Germany, Great Britain, and also examines the national experience of the Ukrainian police in this aspect. The generalization of foreign and national experience in the use of sports potential in the framework of the implementation of the activities of the "Community Policing" concept indicates that in the vast majority they are implemented in the youth and children's environment, which is explained by the purposefulness and purpose of such events - the impact on the consciousness and behavior of individuals in order to form they have positions of voluntary compliance with the rule of law, early preventive intervention, involvement of such persons in meaningful leisure activities. In turn, the underestimation of the use of this tool among adults, according to the author, is a significant drawback of such activities. It is concluded that the use of sports potential by police units in the framework of the implementation of measures of the "Community Policing" concept is an important tool for preventive impact, a means of creating trusting relationships between the population and the police, as well as a means of promoting a healthy lifestyle, a responsible attitude to health. Positively evaluating the national practice of implementing sports projects by the police, the author suggests ways to improve their activities in this direction.
