Анотація
Статтю присвячено аналізу та узагальненню результатів наукових досліджень та правозастосовної практики щодо організації і планування розслідування незаконного поводження зі зброєю та бойовими припасами. Аргументовано вагоме значення організаційно-практичної моделі розслідування досліджуваного кримінального правопорушення. Здійснений аналіз складових елементів організації і планування. Визначено наявність умов, що впливають на якість розслідування. Наголошено на кваліфікованому підході проведення організації і планування діяльності слідчого для швидкого розкриття кримінального правопорушення.
Formulation of the problem. The deliberate activity of an investigator on disclosure of a criminal offense cannot be effective without properly ordered the investigation process through organization and planning. Planning, in essence, constitutes the logical basis of the organizational process, which specifies and defines the basic structural elements of such activity, and the organization is the beginning of the investigation, from the timeliness and quality of which favorable conditions are created for establishing the truth in criminal proceedings.
Analysis of the recent research and publications. The issues of organization and planning were adequately researched by leading criminologists. Considerable attention was paid to their correlation. As a consequence, planning of an investigation often involves the organization as an integral element (part). In this issue, we are in agreement with the opinion of scholars who consider planning a narrower notion than organization. At the same time, there are still no theoretical studies of these definitions as part of the investigation into the unlawful handling of weapons and ammunition.
The purpose of the article is to highlight some theoretical aspects of organization and planning of investigation into the unlawful handling of weapons and ammunition, taking into account current realities and needs of law enforcement practice.
The article analyzes and summarizes the results of scientific research and enforcement practice in organization and planning of investigation into the unlawful handling of weapons and ammunition. The significance of the organizational-practical model of investigation of the researched criminal offense is substantiated. An analysis of the constituent elements of organization and planning is carried out. The existence of conditions influencing the quality of the investigation has been determined. It is emphasized on the qualified approach of organization and planning of the investigator's activity for quick disclosure of the criminal offense.
