Анотація
У статті проаналізовано положення КУпАП, які регламентують право на захист особи, яка вчинила адміністративне правопорушення у сфері забезпечення безпеки дорожнього руху, розгляд якого належить до компетенції Національної поліції. Надано характеристику таким суб’єктам забезпечення права на захист, як адвокат та ін-ший фахівець у галузі права, який, згідно із законом, має право надавати правову допомогу. Акцентовано увагу на особливостях забезпечення права на захист у зазначеній категорії проваджень.
Administrative tort legal relations that regulate the administrative liability of citizens remain one of the most controversial spheres of relationship between the representatives of the National Police and the society; bringing the person to administrative liability for committing the offense in the field of ensuring the traffic safety is not an exception.
So, for example, the great number of components of administrative offenses in the field of ensuring the traffic safety, their qualitative heterogeneity, so called simplified administrative proceedings of the specified delicts, statutory duty of the representatives of the patrol police to take a decision at the scene of the offense (if the consideration of those cases is within the competence of the National Police) objectively complicate the observance of rights and freedoms of citizens.
Taking into account the urgency of the issue, the author has analyzed the provisions of the Code of Ukraine on Administrative Offenses that regulates the right to protection of the person who committed an administrative offense in the field of ensuring the traffic safety, the consideration of which is within the competence of the National Police. The characteristics of those subjects of ensuring the right toprotection as a lawyer and another legal specialist who has right under the law to provide legal assistance are given. The greater focus is placed on the special aspects of observance the right to protection in that category of proceedings.
On the basis of the undertaken research the author proposes amendments to certain provisions of the Code of Ukraine on Administrative Offenses.
