| dc.description.abstract | У статті зазначено, що взаємодія правоохоронних, контрольно-ревізійних та інших суб’єктів щодо запобігання правопорушенням у сфері будівництва – це побудований на адміністративно-правових засадах, взаємний, узгоджений за часом, місцем і змістом зв’язок відповідних суб’єктів, який передбачає диференціацію їх функцій і завдань, спрямований на досягнення певного визначеного результату із можливістю внесення пропозицій та впливу на прийняття рішень із конкретних питань щодо профілактики протиправної діяльності, запобігання і протидії правопорушенням у сфері будівництва, що забезпечує притягнення винних у вчиненні таких порушень до відповідальності, а так само усунення причин та умов, які сприяють вчиненню таких правопорушень Встановлено, що під час здійснення взаємодії застосовуються різні за своїм характером методи, спрямовані на організацію й забезпечення ефективної співпраці щодо запобігання правопорушенням у сфері будівництва. Однак, вони не мають належного нормативного оформлення. Саме тому, вважаємо, що логічним буде розширити напрями відомчої та міжвідомчої взаємодії у досліджуваній сфері, через деталізацію їх у спільному наказі правоохоронних та контролюючих органів і сформулювати у такий спосіб: організація реалізації державної політики із забезпечення економічної (фінансової) безпеки у сфері будівництва через здійснення заходів щодо запобігання правопорушенням; забезпечення комплексного розвитку будівельної галузі на території України; реалізація заходів зі зміцнення безпеки та правопорядку у сфері будівництва (профілактика правопорушень; виявлення, припинення й розслідування правопорушень; притягнення осіб, які вчиняють правопорушення до відповідальності (забезпечення невідворотності покарання); удосконалення правової бази протидії загрозам у будівельній сфері тощо). Такий нормативно-правовий акт відповідав би вимогам європейських та міжнародних конвенцій і повністю регулював б питання взаємодії правоохоронних органів з контролюючими та іншими суб’єктами (органами місцевого самоврядування, громадськості тощо) щодо запобігання правопорушенням у сфері будівництва. Наголошено, також, на доцільності поширення засобах медіа висвітлення змісту правопорушень у сфері будівництва та наслідків, що слідують за ним як профілактичний захід, тим більше, що для цього необхідно тільки узгодити діяльність центру зв’язків з громадськістю з відповідними службами поліції та органами архітектурно-будівельного контролю, які б надавали таку інформацію. The article states that the interaction of law enforcement, control and audit and other subjects regarding the prevention of offenses in the field of construction is a relationship of the relevant subjects built on administrative and legal principles, mutual, coordinated in terms of time, place and content, which provides differentiation of their functions and tasks, aimed at achieving a certain defined result with the possibility of making proposals and influencing decision-making on specific issues regarding the prevention of illegal activities, prevention and countermeasures against offenses in the field of construction, which ensures the prosecution of those guilty of such violations, as well as the elimination of the causes and conditions that contribute to the commission of such offenses It was established that during the implementation of the interaction, methods of different nature are used, aimed at organizing and ensuring effective cooperation in the prevention of offenses in the field of construction. However, they do not have the proper regulatory design. That is why we believe that it would be logical to expand the directions of departmental and interdepartmental cooperation in the researched area, by detailing them in a joint order of law enforcement and control bodies and formulating in the following way: the organization of the implementation of the state policy to ensure economic (financial) security in the field of construction through the implementation measures to prevent offenses; ensuring comprehensive development of the construction industry on the territory of Ukraine; implementation of measures to strengthen safety and law and order in the field of construction (prevention of offenses; detection, termination and investigation of offenses; bringing persons who commit offenses to justice (ensuring the inevitability of punishment); improvement of the legal framework for countering threats in the construction sector, etc.). Such a normative legal act would meet the requirements of European and international conventions and would fully regulate the issue of interaction of law enforcement agencies with controlling and other subjects (local self-government bodies, the public, etc.) regarding the prevention of offenses in the field of construction. It was also emphasized the expediency of media coverage of the content of offenses in the field of construction and the consequences that follow it as a preventive measure, especially since for this it is only necessary to coordinate the activities of the public relations center with the relevant police services and bodies of architectural of construction control, which would provide such information. | |
