Анотація
Статтю присвячено розкриттю змісту кримінально-правового аспекту оперативно-розшукової характеристики шахрайств, учинених в кіберпросторі. Додатково акцентовано на сутності шахрайства. Надано авторське бачення поняття «шахрайство в кіберпросторі».
Наголошено, що такий злочин направлений не на стабільність функціонування електронно-обчислювальних машин (комп’ютерів), автоматизованих систем та/або комп’ютерних мереж, мереж електрозв’язку, а на суспільні відносини з огляду заволодіння майном або правом на це майно. Тому предметом досліджуваного виду шахрайства не може бути електронно-обчислювальні машини (комп’ютери), автоматизовані системи та/або комп’ютерні мережі, мережі електрозв’язку.
У висновках акцентовано увагу на необхідності адаптації правоохоронних органів до швидкозмінюючого кіберпростору та використанні новітніх технологій для протидії шахрайствам.
The relevance of the study of fraud in cyberspace is justified against the background of the rapid development of the digital society and the growth of quantitative indicators of such a socially dangerous act. After all, cyberspace is becoming an increasingly important component of modern life, and along with it, threats to social relations in this environment arise.
According to the statistics of the Prosecutor General's Office, fraud ranks second among property crimes, after theft. Of them, about 12 % is the researched category – fraud committed through illegal operations using electronic computing equipment, where every second remains unsolved, which indicates a systematic opposition to this by law enforcement agencies.
First of all, this is due to the improper legal assessment of such a phenomenon, its identification, which requires a systematic study and improvement of the existing gap.
In this regard, the study is dedicated to revealing the content of the criminal-legal aspect of the operative-investigative characteristics of fraud committed in cyberspace. The essence of fraud is additionally emphasized. The author's vision of the concept of "fraud in cyberspace" is provided.
It is emphasized that such a crime is not aimed at the stability of the functioning of electronic computing machines (computers), automated systems and/or computer networks, telecommunications networks, but at social relations in view of the acquisition of property or the right to this property. Therefore, the subject of the investigated type of fraud cannot be electronic computing machines (computers), automated systems and/or computer networks, telecommunication networks.
The conclusions emphasize the need to adapt law enforcement agencies to the rapidly changing cyberspace and use the latest technologies to combat fraud.
