| dc.description.abstract | У статті наголошено, що сфера будівництва із виникненням держави, розвитком її правової системи, отримала імплементацію в господарських, адміністративних, процесуальних та інших нормах галузевого й міжгалузевого законодавства. Аналіз історичних правових джерел свідчить про те, що певні елементи стандартизації досліджуваної сфери почали використовуватись на етнічних територіях України за часів Київської Русі тобто, історичні витоки правового забезпечення безпосередньо пов’язані із становлення державності в цілому й тривають до сьогодення, оскільки, у КУпАП та інших нормативно-правових актах, переважно підзаконних, продовжується постійна тенденція до впровадження нових норм стосовно стандартів, правил, техніки будівництва. Зважаючи на тернистий історичний шлях становлення законодавства про регулювання будівельної галузі України, ґенезис нормативно-правового забезпечення її адміністративно-правової охорони автором проведено її періодизацію, яка розкриває увесь історичний процес держави та права України, а також специфіку відношення влади до проблем управління та правового регулювання такої галузі з характерними рисами: непослідовність; фрагментарність; розрізненість; невелика кількість джерел, які мали різне походження, неоднакову форму й вирізнялися різним змістом та історичним значенням. Численні трансформації відповідали вимогам часу та були нерозривно пов’язані із розвитком промисловості, станом законодавства й політико-правовою системою влади, яка панувала на українських землях, як в часи відсутності державності, так і після її відновлення. Головною проблемою законодавства була відсутність єдиного підходу до заходів адміністративно-правового реагування на вчинення правопорушень та визначення їх місця. Розкриваючи генезу законодавства у сфері будівництва визначено існуючі загрози національним економічним інтересам України. У зв’язку з чим, наголошено, що зменшення негативного впливу від протиправної діяльності у сфері будівництва на інвестиційний клімат та економічну безпеку держави можливо досягнути шляхом: прийняттям Стратегії запобігання правопорушення в сфері економіки, що відповідала б інтересам суспільства з ринковою економікою, з урахуванням умов воєнного стану; реалізації стратегічної програми боротьби з правопорушеннями в сфері економіки; створення необхідних механізмів щодо забезпечення виявлення та нейтралізації негативних процесів і явищ, що породжують економічну протиправність чи їй сприяють; запобігання «тінізації» економіки України; впровадження дієвих адміністративно-правових інструментів виявлення та припинення правопорушень у сфері будівництва й осіб, які їх вчинили; визначення пріоритетності у фінансовому забезпеченні механізму запобігання правопорушенням; вжиття заходів, спрямованих на забезпечення діяльності суб’єктів підприємницької діяльності як резидентів, так і нерезидентів України; проведення постійного моніторингу протиправних процесів в економічній та пов’язаних із нею сферах держави; вжиття заходів, спрямованих на забезпечення відшкодування шкоди державі, а також фізичним та юридичним особам; викриття фактів встановлення корумпованих зв’язків з державними службовцями, а також посадовими особами усіх рівнів; здійснення заходів щодо добору, розстановки, професійної підготовки та перепідготовки кадрів для правоохоронних та контрольно-ревізійних органів; належного заохочування громадян, які надають допомогу у виявленні правопорушень; інформування населення країни про стан а результати боротьби з правопорушеннями у сфері економіки через висвітлення в засобах медіа. The article emphasizes that the field of construction with the emergence of the state and the development of its legal system was implemented in economic, administrative, procedural and other norms of industry and inter-industry legislation. The analysis of historical legal sources shows that certain elements of the standardization of the studied area began to be used in the ethnic territories of Ukraine during the time of Kyivan Rus, i.e., the historical origins of legal support are directly related to the formation of statehood in general and continue to the present, since, in the Code of Administrative Offenses and other normative legal acts, mainly by-laws, continue the constant trend towards the introduction of new norms regarding standards, rules, and construction techniques. Taking into account the thorny historical path of the formation of legislation on the regulation of the construction industry of Ukraine, the genesis of the regulatory and legal provision of its administrative and legal protection, the author carried out its periodization, which reveals the entire historical process of the state and law of Ukraine, as well as the specifics of the government’s relationship to the problems of management and legal regulation of such industries with characteristic features: inconsistency; fragmentation; diversity; a small number of sources, which had different origins, different forms and differed in content and historical significance. Numerous transformations met the requirements of the time and were inextricably linked with the development of industry, the state of legislation and the political and legal system of power that prevailed in Ukrainian lands, both during the absence of statehood and after its restoration. The main problem of the legislation was the lack of a unified approach to measures of administrative and legal response to the commission of offenses and determining their location. Revealing the genesis of legislation in the field of construction, the existing threats to the national economic interests of Ukraine are identified. In this regard, it was emphasized that reducing the negative impact of illegal activities in the field of construction on the investment climate and economic security of the state can be achieved by: adopting the Strategy for the prevention of offenses in the field of economy, which would correspond to the interests of society with a market economy, taking into account the conditions martial law; implementation of a strategic program for combating offenses in the economic sphere; creation of the necessary mechanisms to ensure detection and neutralization of negative processes and phenomena that generate economic illegality or contribute to it; prevention of «shading» of Ukraine’s economy; implementation of effective administrative and legal tools for detection and termination of offenses in the field of construction and the persons who committed them; determination of priority in the financial provision of the crime prevention mechanism; taking measures aimed at ensuring the activities of business entities, both residents and non-residents of Ukraine; conducting constant monitoring of illegal processes in the economic and related spheres of the state; taking measures aimed at providing compensation for damage to the state, as well as to individuals and legal entities; exposing the facts of the establishment of corrupt relations with civil servants, as well as officials of all levels; implementation of measures regarding the selection, placement, professional training and retraining of personnel for law enforcement and control and audit bodies; proper encouragement of citizens who provide assistance in detecting offenses; informing the population of the country about the state and results of combating crimes in the economic sphere through coverage in the media. | |
