| dc.description.abstract | Статтю присвячено аналізу та узагальненню результатів наукових досліджень і правозастосовної практики щодо тактичних особливостей обшуку за фактом незаконного поводження зі зброєю та бойовими припасами. Аргументовано вагомий інформаційно-доказовий потенціал обшуку за досліджуваним кримінальним правопорушенням. Проаналізовано тактичні особливості кожної стадії даної слідчої (розшукової) дій та сформульовано пропозиції щодо їх удосконалення. Зокрема, з’ясовано, що для обґрунтування необхідності проведення обшуку та для підвищення майбутньої пошукової діяльності на підготовчій стадії треба здійснити ретельне збирання орієнтуючої інформації. Одним із ефективних засобів збору є запровадження інституту НСРД. У невідкладних випадках, передбачених ч. 3 ст. 233 КПК України, системно-структурні елементи підготовчої діяльності реалізуються за необхідністю. Наголошено, що на робочій стадії обшуку обов’язково повинні виконуватись імперативні вимоги законодавства. Рекомендовано до участі залучати спеціаліста-психолога або штатного психолога. Встановлено, що успіх обшуку залежить від правильного та ефективного застосування тактичних прийомів і рекомендацій. Здійснено аналіз цих прийомів. Наголошено на їх системному застосуванні для цілеспрямованого пошуку у різних ситуаціях та для підвищення результативності тактики пошукової діяльності. One of the important procedural means of obtaining evidence is search. The essence of this investigative (search) action lies in the compulsory inspection of housing, other possession of a person, individual citizens for the purpose of finding and seizing objects that are relevant for criminal proceedings, as well as locating and detaining wanted persons. The tactical features of the search are sufficiently covered in the forensic literature. However, the study of modern investigative practice indicates that there are significant difficulties in conducting this investigative (search) action. As a result, in comparison with the period 2013 - 2019, the level of introduction of this institute on the illicit handling weapon and ammunition decreased more than 2 times, and the changes made to the CPC of Ukraine from 16.11.2017 require updating of the tactics of the search taking into account the legislative peculiarities. In this regard, there was a need for coverage of organizational measures and tactical methods of conducting searches on the investigated criminal offense. The article analyzes and summarizes the results of scientific research and law enforcement practice on the tactical features of the search for the illicit handling weapon and ammunition. Significant information-evidence potential search of the investigated criminal offense is substantiated. Tactical peculiarities of each stage of this investigative (search) action are analyzed and suggestions for their improvement are formulated. In particular, it has been found that a thorough collection of guidance information is needed to substantiate the need for a search and to enhance future search activity at the preparatory stage. One of the effective means of collection is the introduction of the Institute of Covert Investigative (detective) Actions. In the urgent cases provided for in Part 3 of Art. 233 of the CPC of Ukraine, system-structural elements of preparatory activity are implemented as needed. It is emphasized that imperative requirements of the legislation must be complied with at the working stage of the search. It is recommended to involve a specialist psychologist or a full-time psychologist. The tactical methods of the search were analyzed. They are emphasized on their systematic application for purposeful search in different situations and for improving the effectiveness of search tactics. | |
