dc.description.abstractУ статті досліджено розмежування предмета відання у кримінальному процесі. Проаналізовано теоретичні уявлення щодо категорії «межі». Визначено критерії розмежування предмета відання у кримінальному провадженні, зокрема роз- межування генерального предмета відання на функціональні предмети відання; розмежування функціонального предмета відання на суб’єктні; розмежування суб’єктного предмета відання. Виокремлено принципи розмежування предмета відання у кримінальному процесі: організаційно-процесуальний та організаційно-технічний принципи розмежування. Організаційно-технічний принцип розмежування предмета відання включає такі критерії: відомчий, територіальний та внутрівідомчий. The article explores the delimitation of the subject of jurisdiction in the criminal process. Theoretical representations concerning the category «limits» are analyzed. The criteria for distinguishing the subject of jurisdiction in the criminal process, in particular, the delimitation of the general subject of jurisdiction on functional subjects of jurisdiction, are determined; the delineation of the functional subject of jurisdiction on the subject; delineation of the personal subject matter. The principles of delineation of the subject of jurisdiction in the criminal process are singled out. The organizational and technical principle of the delineation of the subject of teaching includes the following criteria: departmental, territorial and in-service.
