Анотація
Статтю присвячено проблемним питанням огляду трупу на місці події та подальшого негайного призначення судово-медичної експертизи трупу. Встановлено, що є певні прогалини в законодавстві, які не дають можливості слідчому повноцінно та ефективно здійснювати досудове розслідування. Проблемним питанням є законодавче визначення проведення, до внесення відомостей до Єдиного реєстру досудових розслідувань, лише огляду місця події, не вказуючи про можливість огляду трупу. Звернено увагу на те, що зволікання з оглядом трупу та подальшим призначенням судово-медичної експертизи такого трупу може негативно вплинути на збір доказової інформації. Констатовано, що огляд трупу має бути проведено якнайшвидше після його виявлення на місці події, та невідкладно після проведення його огляду призначено судово-медичну експертизу для встановлення причин смерті тощо. Запропоновано внести зміни до кримінального процесуального кодексу України, які вдосконалять діюче законодавство та покращать роботу органів досудового розслідування.
The article is devoted to the problematic issues of the examination of the corpse at the scene of the incident and the subsequent immediate appointment of a forensic medical examination of the corpse. It has been established that there are certain gaps in the legislation that do not allow the investigator to fully and effectively conduct a pretrial investigation. A problematic issue is the legislative determination of conducting, before entering information into the Unified Register of Pretrial Investigations, only an inspection of the scene of the incident, without indicating the possibility of an inspection of the corpse. Attention has been drawn to the fact that delaying the examination of a corpse and the subsequent appointment of a forensic medical examination of such a corpse may negatively affect the collection of evidentiary information. It was established that an examination of the corpse should be carried out as soon as possible after its discovery at the scene, and immediately after its examination, a forensic medical examination was appointed to determine the cause of death, etc. It is proposed to make changes to the criminal procedural code of Ukraine, which will improve the current legislation and improve the work of pretrial investigation bodies.
