| dc.description.abstract | У статті здійснено розгляд термінологічного розуміння поняття «звільнення», окреслено співвідношення вказаного поняття із іншими подібними термінами такими як: «припинення трудового договору чи припинення трудових правовідносин», «розірвання трудового договору», «вивільнення працівника». Встановлено, що нормами центрального закону, яким регулюється питання правових засад організації та діяльності Національної поліції України – Законом України «Про Національну поліцію» від 02.07.2015 № 580-VIII не надано чіткого термінологічного розуміння поняття «звільнення зі служби в органах поліції», що унеможливлює його єдине формулювання, однозначне тлумачення та розуміння всіма суб’єктами, які беруть учать у трудових правовідносинах із Національною поліцією України. А чітка визначеність категорії «звільнення» є важливою як для працівників так і для роботодавців, оскільки від його формулювання визначається зміст таких правовідносин, встановлюється механізм звільнення, окреслюються стадії звільнення тощо. Пропонується перелік та характеристика ознак процесу звільнення. Серед основних визначаються: тривалість процесу; припинення правових відносин; чітка регламентація; стадійність процесу звільнення з підрозділів Національної поліції; наявність уповноважених суб’єктів, які забезпечують «рух» цього процесу; наявність конкретного кола підстав для запуску цього процесу. Автором наголошено на тому, що в окремих законах та нормативно-правових актах здійснюється розмежування підстав щодо звільнення особи та припинення нею служби, а в профільному законі «Про Національну поліцію» недоречним є назва статті про звільнення з посади, оскільки ця назва включає в себе як позитивні аспекти припинення служби в поліції, так і містить негативний аспект. Дослідником запропоновано власне розуміння поняття «звільнення з органів Національної поліції» та виділено основні ознаки звільнення з поліції/ The article examines the terminological understanding of the concept of»dismissal”, defines the relationship of this concept with other similar terms such as:»termination of an employment contract or termination of labor legal relations”, “termination of an employment contract”, “release of an employee”. It has been established that the norms of the central law, which regulate the issue of the legal foundations of the organization and activities of the National Police of Ukraine – the Law of Ukraine “On the National Police» dated 02.07.2015 No. 580-VIII does not provide a clear terminological understanding of the concept of “dismissal from service in the police”, which makes it impossible for a single interpretation of this wording, an unambiguous interpretation and understanding by all subjects who participate in labor relations with the National Police of Ukraine. A clear definition of the category of “dismissal” is important for both employees and employers, since its wording determines the content of such legal relations, the dismissal mechanism is established, the stages of dismissal are determined, and the like. A list and characteristics of the signs of the dismissal process are proposed. Among the main ones stand out: the duration of the process; termination of legal relations; clear regulation; the stages of the process of dismissal from the units of the National Police; the presence of authorized entities that ensure the “movement” of this process; the existence of a specific range of grounds for starting this process. The author noted that in some laws and regulations, the grounds for dismissal of a person and termination of service are differentiated, and in the profile law “On the National Police” the title of the article on dismissal from office is inappropriate, since this title includes both positive aspects of termination service in the police and contains a negative aspect. The researcher proposed his own understanding of the concept of “dismissal from the bodies of the National Police” and highlighted its main features. | |
