Опис
В статті розглянуто особливості проведення такої слідчої (розшукової) дії, як обшук. Виділено тактичні завдання даної процесуальної дії, найбільш значимі об’єкти пошуку та місця їх знаходження. Сформульовано рекомендації щодо тактики обшуку при розслідуванні незаконного видобування вугілля в залежності від слідчої ситуації. Визначено важливість проведення зазначеної слідчої (розшукової) дії для організації розслідування даного різновиду злочину.
In the article the features of conduction of a search in the investigation of illegal coal mining.
The author done the significant work on the generalization of scientific research on criminalistic investigations ecological crimes. Given the theoretical foundations of conduction of a search described in the literature, and being based on data from conducted research highlighted tactics tasks of the search, the most significant searching objects and their location in the investigation of crimes on the facts of illegal coal mining.
Analysis and generalization of materials of criminal cases into the illegal coal mining made it possible to conclude that the search as a separate investigative (detective) action as a part of tactical operations, has a pronounced character of situational. Recommendations regarding the organization and tactics of of the search depending on the investigation of the situation.
When conducting of the search must comply with the tactical requirements developed of Criminalistics: suddenness of search; sustainability and consistency of its holding; the use of scientific and technical means. Based on the results of referrals of criminal proceedings (cases) author of the article was proposed system tactical methods that provided the creative of application can play a positive role in different situations conduction of a search in the investigation of illegal coal mining. The article noted that all of these tactical methods should be applied depending on the complex investigatory of the situation at a certain stage of pre-trial investigation.
In conclusion, the author stated that the successful conduct of the search in the investigation of illegal coal mining is possible only if a thorough preparation for this investigatory (investigative) actions and application of complex tactical methods in their most appropriate sequences depending on the specific investigation of the situation.
